JUDICIAL SYSTEM OF ARMENIA NOT INDEPENDENT: HEAD OF HELSINKI ASSOCIATION

YEREVAN, FEBRUARY 10. ARMINFO. Trials currently followed in Armenia by Helsinki Association can be determined as “a crime against justice,” Head of Helsinki Association Michael Danielyan said at a press conference, Thursday.

He said that the judicial system in Armenia was not independent and was an appendage of prosecutor’s office. To prove his words, Danielyan brought two cause celebres. He said that the case of the Nalbandyans, who are sentenced to 19 and 9 years of imprisonment for murder of a 16-year-old girl, has not real proofs of their guilt in the crime. Danielyan also called criminal the attitude of the law-enforcement bodies to Armen Poghosyan, who was innocent, but was charged with raping and murder of a minor girl. Matters took such a turn that after a time the police detained the real criminal, hereby proving A. Poghosyan innocent. However, by that period of time, Poghosyan had already served over 5 years of his sentence. When released from custody, Poghosyan was given “Monte Christo” two-volume edition by Prosecutor General of Armenia Aghvan Hovsepyan, which is a display of top cynicism. Michael Danielyan accused the judges of all instances of unjust verdict and a number of native journalists of indulgence towards the judges.

The lawyer of the organization Sofya Safaryan says that the republican prosecutor’s office has initiated a criminal case again, wherein Armen Poghosyan is a sufferer. The case is under consideration, though the offender is absent at present, she says. Representing Poghosyan, Safaryan applied to the court of Center and Nork-Marash communities demanding compensation of material and moral damage caused to the sufferer, which makes up some 34 million drams.
